New Jersey Tort Claims Notice: You Must File Your Claim Within 90 Days Of The Incident

When bringing a personal injury or other tort claim against the police or against a public entity in New Jersey, you are required to serve a Notice of Tort Claim to preserve your rights under the law within 90 days of the incident (in Pennsylvania, the time period is 180 days). Then, six months after the notice, but before the two-year anniversary of the incident, you can file your lawsuit. Note: Incarceration does not stop the running of the notice period.
