Can you combat a DUI charge?

Being pulled over and arrested for a DUI can be demoralizing. Having a DUI charge on your record can lead to countless consequences that can leave a lasting impact. Fortunately, there are many legal defenses available that may help you avoid any long-term penalties and possibly lead to the dismissal of your case.

Three legal defenses for a DUI

When defending you in court, your lawyer may use any of these DUI defenses:

  • Show that you were illegally pulled over: A police officer needs to have probable cause to legally pull you over. A great way to prove that the stop was illegal is by showing video evidence. If you have a dashcam in your vehicle, you may be able to dispute any claims about your driving. Additionally, proving that the officer did not follow protocol will also benefit your case.
  • Contest the validity of any evidence: Sometimes, officers will justify pulling you over by using video evidence to show that you were driving erratically. If the video does not clearly show you driving poorly, then you may be able to challenge the evidence.
  • Demonstrate the inaccuracy of the chemical tests: If your attorney can prove that the officers failed to follow the procedure when administering the chemical tests, you could have the case dismissed. It is also possible for your lawyer to challenge the accuracy of the test. Though, this usually requires having other experts testify on your behalf.
